This commercial lease agreement builds in various protections for the landlord. It provides for inter alia no warranty as to the suitability of the premises or that the tenant will be granted any requisite licenses, it requires that the tenant comply with all laws/by-laws etc., provides for shared access of shares areas/joint facilities, provides that the landlord may have the right to relocate parking areas, skip bins etc. and remove any unauthorized persons from the shared areas, it indemnifies the landlord against any loss/liability/damages which the landlord may suffer in connection with the tenant accessing the shares areas, the tenant is prohibited from making additions or alteration however also contains protections for the landlord in a situation where the tenant has proceeded to make alterations, it provides for the landlord to make alterations, the lease deals with maintenance and insurance , the landlords right of entry, exclusion of the landlords liability for damage, the exclusion of the tenant’s right to cancel or withhold rental, provides for an indemnity in the landlords favour as well as a limitation of liability, it prohibits assignment and subletting, and provides for general obligations on the tenant such as ensuring the leased premises is clean, maintained and kept in good working order etc., provides for the landlords right to inspect the premises for purposes of showing a new tenant the premises, deals with advertising and a protocol for the tenant to follow for obtaining approval to erect advertising, provides that the landlord may cancel the lease if the premises are destroyed or damaged, provides that the landlord may terminate the lease for purposes of rebuilding and extension of the building /premises by giving the tenant 6 months’ notice, provides thorough consequences for a breach of the lease agreement by the tenant, provides for a cession should the landlord sell the building, it provides for arbitration and contains all of the boiler plate clauses. How it Works:
STEP 1: Register for an account. Download the applicable Financial Intelligence Centre Act 38 of 2001 (FICA) form (https://www.kklaw.co.za/download-fica-document/), fill it in, obtain the necessary supporting documents listed on your FICA form (i.e. identity document, proof of residence etc. ), upload your FICA form together with the necessary supporting documents and your account will be opened. Please bear in mind that unless we have the necessary FICA documents we wont be able to open an account for you and please also bear in mind that the individual or entity who will be paying for the document must fill out the FICA form
STEP 3: Once you have registered for an account you will then be able to purchase the document of your choice. Payment will be made via Pay Fast which will provide you with the option of making payment via credit card, debit card or eft.
STEP 4: Upon purchase of your document you will receive a letter at the email address you have provided during registration requesting specific information from you so that we can personalise your legal document .
STEP 5: We will provide you with your personalised legal document within 72 hours of having provided us with the information requested in our letter addressed to you.
